Data Protection - Cookies – Compliance – Website – Data Protection Act 1998

 

We are approaching the one year anniversary from the end of the UK grace period for cookie compliance. The Information Commissioner’s Office’s (“ICO”) Activity Report, which was published in December 2012, gives us an idea about what organisations are doing in practice.

 

It is clear that the vast majority of websites are seeking to rely on implied consent with the use of cookies, taking the form of a pop up when a user enters the website as well as a formal cookie policy located elsewhere on the website.

 

The Activity Report also sheds light on what consumers are most concerned about.
